{"id":2963,"date":"2017-12-20T10:38:48","date_gmt":"2017-12-20T05:08:48","guid":{"rendered":"https:\/\/old.anandandanand.com\/oldupdates\/?p=2963"},"modified":"2018-01-03T14:38:11","modified_gmt":"2018-01-03T09:08:11","slug":"high-court-issues-clear-directions-registration-mark-well-known","status":"publish","type":"post","link":"https:\/\/old.anandandanand.com\/oldupdates\/high-court-issues-clear-directions-registration-mark-well-known\/","title":{"rendered":"High Court issues Clear Directions for Registration of Mark as Well-Known"},"content":{"rendered":"<p><em>Clear directions issued by court regarding registration of well-known marks in one of the first cases since the introduction of Rule 124 of the Trademark Rules 2017.<\/em><\/p>\n<p>In a case involving the TCS trademark owned by Tata Sons Limited, the Delhi High Court issued clear directions regarding the registration of the mark as a <a href=\"https:\/\/old.anandandanand.com\/oldupdates\/?s=well+known\" target=\"_blank\" rel=\"noopener noreferrer\">well-known mark<\/a> with the Trademark Registry.<\/p>\n<p>The court observed that the TATA mark denotes tremendous reputation and goodwill, across industries. The TCS mark, associated with Tata Consultancy Services \u2013 a Tata Group company \u2013 too has immense fame and repute associated with it.<\/p>\n<p>The court directed Tata Sons to make an application to the Registrar of Trademarks under the new Rule 124 of the Trademark Rules, to have the TCS trademark declared as a well-known trademark. Further, the Registrar has been directed to decide the application expeditiously, preferably within three months.<\/p>\n<p><em>Tata Sons Limited &amp; Anr v Mr. Charanjeet Shah &amp; ors; before the Delhi High Court; order dated 22.11.2017 in C.S.
