It submitted that the domain name was being used in bad faith as the respondents had no legitimate reason to claim proximity to Dell.<\/p>\n<p>The tribunal noted that the use of the <a href=\"https:\/\/old.anandandanand.com\/oldupdates\/wipo-orders-korean-national-transfer-biotiquekorea-com-biotique-owner\/\" target=\"_blank\" rel=\"noopener noreferrer\">generic<\/a> term \u2018shopping\u2019 with the DELL mark created <a href=\"https:\/\/old.anandandanand.com\/oldupdates\/part-2-behind-scenes-duplicitous-domain\/\" target=\"_blank\" rel=\"noopener noreferrer\">confusion for consumers<\/a>, who would be led to believe that the respondents were related to Dell. Particularly since it owns several thousand <a href=\"https:\/\/old.anandandanand.com\/oldupdates\/tag\/domain-name\" target=\"_blank\" rel=\"noopener noreferrer\">domain names<\/a>, including such derivatives as \u2018dellcenter.in\u2019 and \u2018dellstores.in\u2019.<\/p>\n<p>They would expect \u2013 and reasonably so \u2013 \u2018dellshopping.in\u2019 to be an official website of Dell\u2019s, and the goods and services to be advertised by an authorised reseller, which the respondent was not.<\/p>\n<p>NIXI concluded adoption of the Dell mark in their domain name a show of \u2018opportunistic bad faith\u2019 by the respondents. \u2018Dellshopping.in\u2019 was ordered to be transferred to Dell.<\/p>\n<p><em>Dell Inc, USA v Ram Selvam; before the National Internet Exchange of India; order dated 26.10.2017<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>NIXI concludes \u2018opportunistic bad faith\u2019 by respondents for use of Dell mark for their domain. \u2018Dellshopping.in\u2019 ordered to be transferred to Dell to avoid confusing web users.
